Telsim has implemented a Fair Usage Policy to ensure that customers can access Telsim Mobile Services reasonably and responsibly, preventing excessive or exploitative usage under any circumstances. This policy applies to all services provided under Telsim Mobile Services aiming to make these services available to eligible customers without unreasonable usage.
Under this Fair Usage Policy, we have defined acceptable usage for services such as unlimited data transfer plans. Usage levels have been set above normal limits to ensure customers will not be negatively impacted by the policy.
Unreasonable use of Telsim plans or Fair Use Promotions is considered when your use of the listed services or participation in a Fair Use Promotion is deemed by Telsim to be fraudulent or detrimental to the Telsim Network or the ability of other Telsim customers to use or access our services.
Fraudulent use, in particular, includes resupplying a Telsim service without consent, so that others may use Telsim services or exploit a Fair Use Promotion.
All Telsim products and services must be used for individual, private use in a reasonable and acceptable manner. These services are not to be used for business purposes or large group operations. Unreasonable use includes, but is not limited to, leaving a call open unattended for an extended period, mass distribution to multiple recipients, using services for call centers, telemarketing, or wholesaling. The use of calling cards, dialling apps, VoIP services, or rerouting calls to another destination or number, including calling 13xx or 18xx numbers to make indirect calls through other providers, is also prohibited.
Using Telsim products and services for any illegal or unlawful activities is strictly prohibited. This includes submitting false account details for service access, unauthorized hacking or accessing someone else’s information without consent, transmitting Spam, storing or transmitting unlawful data such as pornography or viruses, or violating copyright laws.
Telsim prioritizes customer satisfaction and offers special bonuses, data dollars, discounts, and other offers for your convenience. The introduction of the Fair Usage Policy aims to prevent excessive and fraudulent use of equipment and services in line with our policies. We do not tolerate violence, abusive or harassing behaviour (including offensive or threatening remarks towards staff), fostering hate, propagating discriminatory rhetoric, or posing a threat to the health or safety of individuals. We also prohibit the use of our services to send unsolicited commercial communications (Spam) to individuals or businesses, as this can severely impact our service reliability.
This policy is designed to ensure the integrity and fairness of our services, and we encourage all customers to use them responsibly.
Commercial Purpose
Reselling or exploiting SIM cards or Mobile services provided under Telsim is strictly prohibited. Any attempt to disguise services for resale purposes will also be considered a breach of the Fair Usage Policy. Using our mobile services as a carrier service provider to supply services to other carriage service providers is deemed an infringement of the policy.
Usage Restrictions for Specific Technologies
This includes using services beyond the typical or agreed usage for the account type, such as utilizing residential products for business or commercial purposes.
Additionally, any attempt or participation in the following activities without proper authorization is strictly forbidden:
- Disabling, disrupting, or interfering with the regular operation of any service or network, including overloading, launching denial-of-service attacks, or flooding a network.
- Investigating, scanning, or probing a system or network for vulnerabilities.
- Violating security or authentication measures for any service or network.
- Servicing multiple locations with a single connection.
These actions are not permitted and will be subject to consequences as outlined in our policy.
Unusual or Excessive Usage
Under Telsim, the following are considered excessive use under the Fair Usage Policy:
- Mobile Service Usage: Using more than 2500 minutes per month on a mobile service for two consecutive months is considered excessive.
- SMS Usage: Sending more than 100 text messages in a single day from a mobile phone is considered excessive.
- MMS Usage: Sending MMS messages to more than 50 recipients per day is considered excessive. This includes MMS messages sent to either email addresses or mobile phones.
Unreasonable Usage
Unreasonable usage occurs when a customer’s use of our services leads to network congestion or when services are resupplied without our permission. Such actions are considered a breach of the Fair Usage Policy and fraudulent usage.
If we detect a breach of the Fair Usage Policy, the following actions may be taken:
- We will investigate the breach by contacting you and requesting that you adjust your usage. A formal warning may be issued regarding the breach.
- We reserve the right to suspend or limit access to the Fair Usage Policy services without prior notice.
- You may be required to pay the standard rate for services if we determine you have breached the policy. This will be calculated based on the date we notify you of the charge.
- If you have already paid for the affected mobile, you will be required to pay the difference between what you’ve paid and the standard applicable retail rate (excluding any Fair Usage offers). The calculation will be based on the date we notify you of the discrepancy.
- Should your usage exceed the limits specified in your tariff plan under the Fair Usage Policy, and continue beyond reasonable limits, we may suspend your service or terminate your agreement without further notice.
